Airmen receive court-martial punishments Published March 12, 2015 By 28th Bomb Wing Legal office ELLSWORTH AIR FORCE BASE, S.D. -- During the month of December 2014, the 12th Air Force commander approved the findings and sentence in the following case: Senior Airman Jose H. Gallegos, 28th Maintenance Squadron, was found guilty of one specification of abusive sexual contact at a general court-martial convened by Lt. Gen. Tod Wolters, 12th Air Force commander. A panel of officer and enlisted members found him guilty and a military judge sentenced him to reduction to the grade of airman, 14 days confinement and a bad conduct discharge. Wolters approved the findings and sentence in the case Dec. 15. During the month of December 2014, Col. Kevin Kennedy, 28th Bomb Wing commander approved the findings and sentences in the following cases: During a summary court-martial, Airman 1st Class Miguel A. Vingochea, 28th MXS, pled guilty to one charge and one specification of wrongful use of marijuana. The court-martial officer sentenced him to reduction to the grade of airman basic, 30 days confinement and a reprimand. During a summary court-martial, Senior Airman Michael B. Walters, 28th Munitions Squadron, pled guilty to one charge and one specification of conspiracy to distribute marijuana. The court-martial officer sentenced him to three days confinement, 27 days hard labor and a reprimand. All members of the Armed Forces are subject to the Uniform Code of Military Justice. The UCMJ lists a number of criminal offences. A member who commits one of these offences is subject to trial by court-martial. The rules and procedures for court-martial administration are governed by Air Force Instruction 51-201, "Administration of Military Justice."
